Terms and Conditions

1. Eligibility

You must be at least 18 years of age and legally competent under Indian law to use this platform. Minors or persons disqualified under the Indian Contract Act, 1872 are prohibited from accessing or transacting on the Platform.

2. Services Offered

Wagwan provides digital infrastructure for:

● Listing and managing events.
● Issuing and managing tickets.
● Enabling communication between event organizers and attendees.
● Creating digital communities around events and interests.

We act as a technology intermediary and do not organize or control any events directly unless explicitly stated.

3. Ticketing & Payments

● Responsibility: Event organizers are solely responsible for event quality, cancellations, refunds, and schedule changes. Wagwan does not guarantee the execution or safety of events.

● GST & Compliance: All ticket prices must be GST-inclusive if the organizer is registered under GST. The responsibility of accurate tax filing rests with the organizer.

● Payment Gateway: All payments are processed via third-party gateways (e.g., Razorpay, Cashfree). Wagwan is not liable for gateway downtime, fraud, or delay in settlements.

● Refund Policy: Refunds, if applicable, are managed by the organizer. Wagwan may assist but does not issue refunds directly unless it is the event owner.

4. Communication Services & Data Compliance

By using Wagwan's communication tools (e.g., group chats, notifications, community updates), you agree to:

● Consent to Communication: You provide express consent to receive updates, transactional information, and promotional content via email, SMS, push notifications, or WhatsApp.

● Data Protection: Wagwan complies with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and any applicable DPDP Act 2023. We do not sell or misuse user data.

● Opt-Out: Users may opt out of promotional communications via settings, but transactional updates (ticket confirmations, cancellations, etc.) cannot be opted out of.

5. Content Submitted by Users

You may upload event listings, messages, images, or other media ("User Content"). You retain ownership of your content but grant Wagwan a non-exclusive, royalty-free, worldwide license to use, modify, display, and distribute such content on our platform or promotional materials.

You are responsible for ensuring:

● You own or have rights to publish the content.
● The content does not violate any copyright, privacy, or defamation laws.
● The content is not obscene, illegal, discriminatory, or harmful in nature.

Wagwan reserves the right to moderate, remove, or suspend access to any User Content at its sole discretion.

6. Platform Use & Conduct

You agree:

● Not to engage in scraping, framing, or interfering with the Platform's functionality.
● Not to post misleading, fraudulent, or harmful content.
● Not to harass other users or organizers.
● Not to impersonate others or misrepresent your affiliation.

7. Limitation of Liability

Wagwan World LLP is not liable for:

● Event cancellations, losses, or damages related to third-party events.
● Failures in communication caused by force majeure or service provider issues.
● Unauthorized use of your account due to your negligence.
● Loss of data or business profits due to use or inability to use the Platform.

To the fullest extent permitted by applicable law, Wagwan's total liability shall not exceed the value of tickets purchased via the platform in the preceding 30 days.

8. Indemnity

You agree to indemnify, defend and hold harmless Wagwan World LLP, its founders, employees, partners, and licensors from and against all losses, claims, damages, liabilities, or expenses (including legal fees) arising out of:

● Your use or misuse of the Platform;
● Your violation of any law or third-party rights;
● Any content you submit or host on the Platform.

9. Intellectual Property

All content on the Platform — including but not limited to UI/UX designs, code, branding, and features — are the exclusive property of Wagwan World LLP. You may not replicate, reverse-engineer, or commercially exploit any part without written consent.

10. Governing Law & Dispute Resolution

These terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka. Disputes may be resolved via arbitration under the Arbitration and Conciliation Act, 1996 if both parties agree.

11. Termination

We reserve the right to suspend or terminate your access at any time if you violate these Terms, misuse the platform, or harm our reputation. Upon termination, all pending rights and obligations will survive.
